A Lee County jury has awarded $2 million to parents following the stillbirth of their daughter, concluding a week-long medical malpractice trial. The litigation centered on a misread 20-week anatomy ultrasound that plaintiffs argued deprived the mother of necessary obstetric care during a subsequent high-risk pregnancy.

The case, filed against Radiology Regional, hinged on the interpretation of ultrasound imagery that failed to identify severe facial abnormalities. While the sonographer noted an inability to visualize the baby’s face, the interpreting radiologist reported no defects. Plaintiffs contended that a correct diagnosis would have mandated a transfer of care from a midwife to an obstetrician before the mother developed preeclampsia at 38 weeks. Following the stillbirth, medical examinations confirmed the child suffered from a significant cleft deformity that went undetected during the initial scan.

Throughout the trial, the defense attempted to shift liability toward the treating midwife. However, the jury ultimately held the radiology provider accountable. Ryan Fogg, managing partner of Fogg Law Group, stated the verdict confirms that the child's death was preventable, marking a resolution for parents who pursued the case despite the defense refusing to offer a settlement at any stage of the litigation.
