Capital One Faces California Class Action Over Labor Code Violations

The litigation, filed by attorneys at Blumenthal Nordrehaug Bhowmik De Blouw LLP, asserts that the defendant forced employees to work off-the-clock without proper compensation. Under California Labor Code, employers must pay for all time during which staff remain under company control. The suit, designated Case No. 26STCV18450, claims these practices resulted in the failure to pay minimum wages and overtime premiums in violation of sections 1194, 1197, and 1197.1.

Beyond compensation disputes, the filing highlights discrepancies in payroll documentation. California Labor Code § 226 requires employers to furnish precise itemized wage statements for every pay period. The plaintiff alleges that the statements provided by Capital One failed to include mandatory information, obscuring the actual hours worked and wages earned. The firm is currently seeking to address these grievances through court action on behalf of affected workers.
