Management reported a net loss of $40.7 million for the quarter, maintaining $237.9 million in cash and marketable securities. The company bypassed a traditional analyst session, citing sensitive ongoing discussions with the FDA regarding its regulatory trajectory for Deramiocel, a treatment candidate for Duchenne muscular dystrophy.

The pending lawsuit centers on the period between December 17, 2025, and July 26, 2026. Plaintiffs allege that Capricor executives misled the market by modifying their statistical analysis plan without FDA agreement. These undisclosed changes came to light in late July when the FDA released briefing documents ahead of an advisory committee meeting. The agency noted the HOPE-3 study failed to meet its pre-specified efficacy endpoints, triggering a 64% collapse in Capricor's share price. This followed an earlier 370% surge in December 2025, which preceded a secondary public stock offering.
