Kroger Agrees to $17 Million Settlement Over Prescription Drug Pricing

The litigation centered on whether Kroger failed to account for its proprietary Rx Savings Club and Health Savings Club prices when submitting insurance claims. Plaintiffs alleged that by ignoring these lower, discounted rates, the company artificially inflated the prices reported to insurers. Kroger continues to deny any wrongdoing, maintaining that its reported retail prices were accurate and compliant with industry standards. The court has not issued a ruling on the merits of the allegations.

To participate in the settlement, eligible class members must submit a valid claim form by December 21, 2026. Payments will be distributed from the net fund based on the specific costs incurred by claimants during the designated period. Those who wish to retain their right to sue Kroger independently must opt out of the settlement by October 22, 2026. A final fairness hearing is scheduled for January 11, 2027, at the U.S. District Court for the Southern District of Ohio, where the court will review the proposed distribution and attorneys' fees.
