Lawsuit Claims Fatal Sea-Doo Switch Capsizing Was Preventable

On August 30, 2025, a Labor Day weekend outing turned catastrophic when the pontoon boat nosedived and overturned in nine feet of water. Farhana Nasir, 53, and Kiran Akbar, 23, died at the scene, while 22-year-old Noor Nasir died days later from her injuries. Survivors Khizer Nasir and Hassan Akbar, who witnessed the tragedy, are also plaintiffs in the action represented by Berman & Simmons attorneys Travis M. Brennan and Charles P. Hehmeyer.

The complaint asserts that Bombardier was aware of design flaws leading to capsizing risks, particularly at low speeds. Although a February 2025 recall attempted to address these issues through hull sealant and warning labels, the lawsuit contends the measures failed to rectify the underlying defect. The filing highlights that the U.S. Coast Guard issued a formal safety alert in October 2025 regarding the Switch’s tendency to take on water in the center hull, a hazard linked to other fatal incidents nationwide. Seeking punitive damages and compensation for the survivors, the families argue the company continued to market a vessel they knew to be inherently unsafe.
