Alibaba Faces Securities Class Action Over Alleged Military Ties and AI Fraud

Investors are lining up to join a securities class action against Alibaba Group Holding Limited, following allegations that the tech giant concealed ties to the Chinese military and engaged in unauthorized AI model distillation. The lawsuit, filed in the Southern District of New York, targets losses incurred over the past year.

The legal action, Wistisen v. Alibaba Group Holding Limited, alleges that the company and its executives violated the Securities Exchange Act of 1934 by misrepresenting their regulatory status and business practices between June 26, 2025, and June 24, 2026. Plaintiffs claim Alibaba failed to disclose that it was affiliated with the Chinese Ministry of Industry and Information Technology, triggering designation as a Chinese military company under the National Defense Authorization Act.

Market confidence faltered significantly following two major disclosures. In June 2026, the U.S. Department of Defense officially added Alibaba to its list of military-linked entities, causing shares to drop 3.9%. Shortly after, reports emerged that Alibaba allegedly bypassed security to access Anthropic’s Claude AI models for unauthorized training, or distillation, purposes. This revelation led to a further 4.7% decline in share price. Hagens Berman partner Reed Kathrein stated the firm is investigating whether executives intentionally misled the market regarding these operational risks. Investors seeking to serve as lead plaintiffs in the litigation must file by October 5, 2026.
