The complaint filed by Glancy Prongay Wolke & Rotter LLP asserts that Alibaba misled shareholders by omitting critical information regarding its corporate governance and technological risks. Specifically, the suit alleges the company failed to disclose its classification as a Chinese military company under the National Defense Authorization Act due to its affiliation with the Ministry of Industry and Information Technology (MIIT).

Beyond these governance concerns, the litigation highlights allegations that Alibaba engaged in ongoing distillation attacks against third-party AI models. Plaintiffs contend that these undisclosed risks rendered the company’s public statements about its business operations and future prospects materially misleading.
