The complaint filed against the company centers on statements made following an FDA inspection of Beta Bionics' manufacturing facilities. While the company publicly characterized the resulting Form 483 observations as minor procedural disagreements regarding reportable customer complaints, the lawsuit alleges a much deeper failure. According to the court filing, the FDA's findings actually exposed significant flaws in the company's quality management systems, risk analysis protocols, and its handling of serious device malfunctions.

Plaintiffs argue that Beta Bionics repeatedly reassured investors that the device itself remained safe and that FDA concerns were confined to regulatory interpretations. However, the suit claims these statements were materially misleading, as the company allegedly withheld information regarding unreported events that involved serious patient injuries.
