Alibaba Faces Securities Fraud Lawsuit Over AI Ties and Military Links
Investors who held Alibaba Group Holding Limited shares between June 26, 2025, and June 24, 2026, are facing a pivotal window to join a class action lawsuit. Hagens Berman Sobol Shapiro LLP is representing shareholders, citing systemic misrepresentations regarding the company's ties to the Chinese military and unauthorized AI model usage.

The litigation, filed in the Southern District of New York as Wistisen v. Alibaba Group Holding Limited, centers on claims that executive officers violated the Securities Exchange Act of 1934. The complaint alleges that Alibaba failed to disclose its affiliation with the Chinese Ministry of Industry and Information Technology, a designation that led the U.S. Department of Defense to categorize the firm as a Chinese military company under the National Defense Authorization Act.
Beyond regulatory non-disclosure, the lawsuit highlights allegations of industrial espionage. According to reports, Alibaba utilized thousands of fraudulent accounts to access Anthropic’s Claude AI models. The company allegedly performed distillation attacks to train its own proprietary AI, a practice that directly contradicts previous public claims regarding its internal technological capabilities. These revelations caused significant market volatility, with shares dropping nearly 4% following the military designation in June 2026 and falling an additional 4.7% after the AI espionage reports surfaced.
Reed Kathrein, the Hagens Berman partner heading the investigation, noted that the firm is scrutinizing whether executives intentionally concealed these regulatory and operational risks to inflate stock value. Investors who suffered losses during the designated class period have until October 5, 2026, to file for lead plaintiff status.
