Plaintiffs allege that the company failed to disclose its classification as a Chinese military company under the National Defense Authorization Act, a status that carries significant regulatory weight. Furthermore, the suit addresses claims that Alibaba used fraudulent accounts to conduct unauthorized distillation attacks against Anthropic’s Claude AI models to train its own proprietary systems.

Market reactions to these revelations triggered sharp declines in Alibaba’s share price. Following the Department of Defense’s June 8, 2026, designation of the company as a military entity, the stock dropped nearly 4%. A subsequent report from Bloomberg regarding the AI model breach caused an additional 4.7% slide. Reed Kathrein, the partner leading the investigation, stated that the firm is evaluating whether executives intentionally obscured these operational risks to artificially inflate the company's valuation.
