Alibaba Faces Securities Class Action Over Alleged AI Espionage
A securities fraud class action has been filed against Alibaba Group, alleging the company misled investors by concealing ties to the Chinese military and engaging in unauthorized AI model distillation. The lawsuit, Wistisen v. Alibaba Group, centers on a year-long period of alleged regulatory and operational deception.

The complaint, filed in the Southern District of New York, claims Alibaba executives failed to disclose the company’s affiliation with the Chinese Ministry of Industry and Information Technology. Under the National Defense Authorization Act, these ties categorize Alibaba as a Chinese military company, a status that was not revealed to the market during the class period of June 26, 2025, through June 24, 2026.
Investors suffered losses following two major disclosures. In June 2026, the U.S. Department of Defense officially added Alibaba to its list of military-linked firms, triggering a 3.9% drop in share price. Shortly after, reports emerged that Alibaba had allegedly accessed Anthropic’s Claude AI models through thousands of fraudulent accounts to conduct distillation attacks. This revelation caused a further 4.7% decline in Alibaba ADSs. Reed Kathrein, a partner at Hagens Berman, stated the firm is investigating whether executives intentionally concealed these risks to misrepresent the company’s competitive standing. Investors affected by the stock's volatility have until October 5, 2026, to file for lead plaintiff status.
