Newton argues that marketing language frequently conflates attorney involvement with actual legal representation, leaving consumers unsure if they are protected by a lawyer or merely paying for administrative assistance. He contends that companies must explicitly state who the attorney represents, whether the relationship is automatic, and which specific agreements govern those duties.

This push for clarity follows Newton’s recent commentary in The National Law Review, where he emphasized that legal representation creates a level of professional accountability that sales promises cannot match. According to Newton, consumers should not be forced to decipher complex website disclaimers to determine their own legal standing. By moving these disclosures upstream—requiring transparency before any payment is collected—the industry could prevent the confusion that often plagues exit attempts, ensuring that clients understand exactly whether they are dealing with a salesperson or a lawyer bound by professional duties.
