The agency’s decision affirms an earlier determination under the Enforce and Protect Act, rejecting Greenbrier’s attempt to characterize its railcars and attached components as exempt from formal entry requirements. According to the investigation, the company admitted it did not file necessary documentation or tender required cash deposits for the merchandise, which the government deemed a material omission and a clear instance of duty evasion.

Daniel B. Pickard, lead counsel for the Coalition of Freight Rail Coupler Producers, noted that the ruling serves as a deterrent against unfair trade practices and reinforces the integrity of existing duty orders. Under the finalized decision, Greenbrier must now submit formal consumption entries for the affected railcars and rectify previous non-compliance. While the current ruling mandates procedural corrections, Customs officials emphasized that additional penalties or further enforcement actions remain on the table.
