Oregon County Targets Gas Utility in Landmark Climate Deception Lawsuit

Multnomah County has expanded its ongoing climate litigation, naming NW Natural as a defendant in a move that marks the first time a U.S. gas utility has been targeted in a climate accountability lawsuit for its alleged role in public deception regarding fossil fuel dangers.

The county, which includes Portland, originally filed suit against a group of fossil fuel interests last year. The litigation centers on the 2021 heat dome, an extreme weather event that claimed at least 69 lives in the region. County officials are seeking $50 million in damages specifically related to the heat event, alongside $1.5 billion for future damages and $50 billion for broader climate adaptation efforts.

Jeffrey Simon, co-lead counsel for the county, stated the objective is to hold companies accountable for carbon pollution linked to climate harm. With the addition of NW Natural and the Oregon Institute of Science and Medicine, the lawsuit now counts 24 defendants. A federal judge previously denied an attempt by the oil and gas industry to move the case to federal court, allowing proceedings to continue in the Oregon state system.

Industry observers suggest this expansion could signal a wider push to scrutinize the role of utilities in the fossil fuel economy. Alyssa Johl of the Center for Climate Integrity noted that while NW Natural is the first utility to face such a legal challenge, the practice of marketing methane gas as a climate solution may make others vulnerable to similar accountability efforts.
