The incident occurred when Miller was hit in the head with a hammer by another worker, rendering him unconscious and causing a fall through a dimly lit construction stairwell. Legal counsel for the plaintiff argued that the project suffered from systemic negligence, specifically citing a failure to monitor dangerous behavior and maintain basic safety standards for those on-site. CIVE, Inc. defended the case with a team of over a dozen attorneys from the Houston-based firm Ahmad, Zavitsanos & Mensing.
