Judge dismisses xAI trade secret claims against OpenAI
US District Judge Rita F. Lin dealt a blow to Elon Musk’s xAI on Tuesday, dismissing the company’s lawsuit alleging that OpenAI engaged in a targeted campaign of poaching and intellectual property theft. The ruling grants xAI the opportunity to refile, though the court found current allegations legally insufficient.

Judge Lin’s order highlights a fundamental gap in xAI's argument: the absence of evidence linking OpenAI to the alleged misconduct of individual employees. While xAI pointed to eight staff members who transitioned to OpenAI, the court noted that simply hiring former competitors does not equate to corporate wrongdoing. The judge emphasized that xAI failed to show OpenAI directed any of the reported actions, such as the retention of work chats or unsuccessful attempts to access proprietary data post-departure.
This legal defeat marks another chapter in the deepening antagonism between OpenAI and Elon Musk. Beyond the poaching allegations, the two parties remain locked in a high-stakes battle over OpenAI’s corporate structure. A separate lawsuit challenging the organization’s transition from a nonprofit to a for-profit entity is currently moving toward a jury trial scheduled for April. OpenAI characterized the dismissed trade secrets case as a baseless extension of Musk’s ongoing harassment campaign, while xAI has yet to offer a formal response to the court's decision.
